smartForm Terms of Service

These terms are an agreement between you and SmartApz LLC, a Michigan limited liability company (“SmartApz”, “we”, “us”), for your use of smartForm at smartapz.com/smartform. By creating an account or using smartForm you agree to them.

1. Your account

You must give a valid email address and keep your password safe. You are responsible for what happens in your account. You must be at least 13 years old, and old enough to enter a contract where you live.

2. Your forms and responses

You own your forms and the responses you collect. You give us permission to host, process and display them only as needed to run smartForm for you. You are responsible for what your forms ask, for telling respondents how you will use their answers, and for following the laws that apply to you, including privacy and anti-spam laws.

3. Acceptable use

Don’t use smartForm to: collect passwords, full payment-card numbers or other credentials (phishing); collect sensitive data you are not allowed to collect; send spam; host illegal, hateful, sexually explicit or harmful content or malware; impersonate others; or try to break, overload or get around the limits and security of the service. We may disable forms or accounts that break these rules, and we may remove content when the law requires it.

4. Plans, limits and payment

The Free plan includes 3 forms and 100 responses a month and shows a small “Made with smartForm” note on forms. Pro removes the note, allows file uploads and raises the limits as described on the pricing page. When a monthly response limit is reached, your forms stop accepting new responses until the next month (UTC) or until you upgrade. Paid plans renew automatically each month until canceled; you can cancel any time in your account and keep Pro until the end of the period you paid for. Prices are shown before you pay and are processed by Stripe. Except where the law requires otherwise, payments are not refundable. We may change plans or prices with notice before your next renewal.

5. Availability

We work to keep smartForm running and your data safe, but we can’t promise it will always be available or error-free. Please export anything important (CSV) and keep your own copies.

6. Ending

You can stop using smartForm at any time and ask us to delete your account. We may suspend or end accounts that break these terms or put the service or others at risk.

7. Disclaimer and limit of liability

smartForm is provided “as is” and “as available”, without warranties of any kind, to the fullest extent the law allows. To the fullest extent the law allows, SmartApz will not be liable for indirect, incidental, special or consequential damages, or lost profits or data, and our total liability for any claim is limited to the amount you paid us for smartForm in the 12 months before the claim (or $50 if you paid nothing).

8. Governing law

These terms are governed by the laws of the State of Michigan, USA, without regard to its conflict-of-laws rules. Any dispute will be heard in the state or federal courts located in Michigan, and you and we agree to their jurisdiction.

9. Changes

We may update these terms. If a change is important we will tell account holders by email before it takes effect. Using smartForm after that means you accept the new terms.
