smartCal Terms of Service

Effective October 26, 2026 · SmartApz LLC · עברית

These terms govern your use of smartCal, the scheduling service at smartapz.com/smartcal provided by SmartApz LLC (“SmartApz”, “we”, “us”). By creating an account or booking through smartCal you agree to these terms and to our Privacy Policy.

1. The service

smartCal lets hosts publish booking pages, set availability, and let guests book, pay for, reschedule and cancel meetings. Features such as Shabbat and Yom Tov blocking rely on third-party data (Hebcal.com zmanim); they are provided as a convenience and you remain responsible for your own schedule and observance.

2. Accounts

You must give accurate information, keep your password safe, and be at least 18 (or the age of majority where you live) to open a host account. You are responsible for activity under your account. Tell us at info@smartapz.com if you suspect unauthorized use.

3. Acceptable use

Don't use smartCal to send spam, to collect data you aren't allowed to collect, to impersonate others, for anything illegal, or in a way that disrupts the service or other users. We may suspend accounts that break these rules.

4. Hosts and guests

A booking is an arrangement between the host and the guest. SmartApz is not a party to it and is not responsible for whether a meeting happens, its content, or its outcome. Hosts are responsible for the information they request from guests and for handling it lawfully.

5. Plans, payment and cancellation

6. Google and other integrations

If you connect Google Calendar, you authorize smartCal to read free/busy information and to create, update and delete the events smartCal makes, as described in the Privacy Policy. You can disconnect at any time. Your use of Google services is also subject to Google's terms.

7. Your content

You keep ownership of the content you put into smartCal (event descriptions, questions, settings). You give us permission to host, store and display it as needed to run the service.

8. Availability and changes

We work to keep smartCal running, but it is provided “as is” and “as available”. We may change, suspend or discontinue features, and we'll give reasonable notice of material changes when we can.

9. Disclaimers

To the fullest extent the law allows, SmartApz disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that calendar sync, emails, reminders or zmanim will always be accurate, delivered or on time.

10. Limitation of liability

To the fullest extent the law allows, SmartApz will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or business. Our total liability for any claim relating to smartCal is limited to the amount you paid us in the 12 months before the claim, or US$100 if you paid nothing.

11. Indemnity

You agree to defend and indemnify SmartApz against claims arising from your use of smartCal in violation of these terms or the law.

12. Termination

You can stop using smartCal and delete your account at any time. We may suspend or end accounts that violate these terms. Sections that by their nature should survive (such as 9–13) survive termination.

13. Governing law

These terms are governed by the laws of the State of Michigan, USA, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Michigan, and you and SmartApz consent to their jurisdiction, except where the law of your country requires otherwise.

14. Changes to these terms

We may update these terms; we'll change the date above and, for material changes, notify hosts by email. Continuing to use smartCal after changes take effect means you accept them.
